3. Rate Limits and Fair Usage
To ensure the quality and availability of the Service for all users, we impose rate limits and fair usage policies:
- API Rate Limits: API requests are subject to per-minute, per-hour, and per-day rate limits as documented in our API documentation. Exceeding these limits will result in temporary throttling or blocking.
- Crawling Limits: Website audits and crawls are subject to fair usage limits based on your subscription tier. Excessive crawling that degrades the Service or impacts target websites may result in account restrictions.
- Concurrent Requests: You may not exceed the concurrent request limits associated with your plan.
- Resource Consumption: You may not engage in activities that consume disproportionate system resources, including CPU, memory, storage, or bandwidth.
4. Data Scraping and Collection Policies
- You may only use the Service to collect and analyze data from websites you own, operate, or have explicit authorization to audit.
- You may not use the Service to harvest email addresses, phone numbers, or other personal contact information from websites without the consent of the data subjects and in compliance with applicable privacy laws (including GDPR and CAN-SPAM).
- You must respect the robots.txt directives and terms of service of target websites.
- You may not use data obtained through the Service for unsolicited outreach that violates applicable anti-spam laws.
- Bulk export of data from the Service for the purpose of building a competing database or service is prohibited.
5. Email and Outreach Policies
If you use the Service's outreach or email features, you agree to:
- Comply with all applicable email marketing laws, including CAN-SPAM, GDPR, and CASL.
- Only contact individuals who have consented to receive communications or with whom you have a legitimate business relationship.
- Include accurate sender information and a functional unsubscribe mechanism in all outreach communications.
- Honor unsubscribe requests within 10 business days.
- Not use deceptive subject lines or misleading header information.
6. Account Responsibility
You are responsible for all activity conducted through your account, including activity by team members, API integrations, and any third parties you grant access to. You agree to ensure that all individuals with access to your account comply with this AUP.
7. Enforcement
We reserve the right to investigate suspected violations of this AUP and take appropriate action, including:
- Warning: Issuing a formal warning for minor or first-time violations.
- Throttling: Temporarily reducing your access to certain features or rate limits.
- Suspension: Temporarily suspending your account pending investigation.
- Termination: Permanently terminating your account for serious or repeated violations.
- Legal Action: Pursuing legal remedies for violations that cause harm to us, our users, or third parties.
We will make reasonable efforts to notify you before taking enforcement action, except in cases where immediate action is necessary to protect the Service or its users.
8. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at support@leadauditpro.com. We take all reports seriously and will investigate promptly.
9. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised policy.
